  • This webinar examined insurance coverage, water damage claims, and maintenance responsibilities in community schemes, with particular focus on resultant damage and recent storm-related issues in the Western Cape. Sarah opened the session by outlining the legal framework under the Sectional Titles Schemes Management Act 8 of 2011 (STSMA), explaining that body corporates are responsible for insuring buildings and common property, while owners are generally responsible for their contents. She highlighted the concept of resultant damage, secondary damage arising from an insured event such as a burst pipe, and stressed that compliance with maintenance obligations is essential, as neglected maintenance can lead to claim repudiation.

    Mike then discussed practical insurance claim scenarios, distinguishing between sudden insured events, such as burst pipes, and damage caused by wear and tear, which is generally excluded from cover. He explained how insurers assess mixed-cause claims and emphasised the importance of submitting claims so that insurers can determine coverage. His presentation also addressed common storm-related claims, including roof damage, water ingress, and the implications of under- or over-insuring properties.

    Tony provided a managing agent's perspective on maintenance and compliance, focusing on the proactive management of risks such as roof defects, stormwater drainage issues, tree hazards, and lightning protection. He explained that regular maintenance not only protects residents and property but also helps schemes remain compliant with insurance requirements and reduces the risk of policy cancellation or claim repudiation.

    The webinar concluded with a Q&A session covering excess payments, claims procedures, insurance cover for improvements, and the allocation of responsibility between body corporates and owners. Throughout the discussion, the presenters emphasised the close relationship between insurance coverage, maintenance compliance, and effective risk management in community schemes.
