GENERAL
As our client, it is your responsibility to provide comprehensive and correct information and documentation. Failure to do so may affect the outcome of the legal advice we provide, as the advice given is based on the information provided.
TVDM Consultants will not be held liable to you or to any third party for any factual or legal errors made in good faith. As the law is subject to interpretation, we apply the facts given to us in order to reach a conclusion, and therefore TVDM Consultants does not guarantee, or give any representation, warranty, or indemnity with regard to the advice given. The advice of TVDM Consultants is given, based on information provided by you, and therefore TVDM Consultants will not be held liable should you distribute the advice given.TVDM Consultants will not undertake instructions on a contingency fee basis.
Prior to any service taking place, you will be required to complete our online mandate form.
Following the consultation scheduled and/or instruction undertaken, TVDM Consultants will provide an invoice as per our services. All payments are to be made into the bank account, as set out on the invoice, by using the reference provided.
TVDM Consultants reserve the rights to terminate any completed mandate through a notice sent to you at any time, without any claim whatsoever against us.
CANCELLATIONS
Should you need to cancel your scheduled consultation, we require notice of such cancellation at least 24 hours prior to the consultation. You will have the option to reschedule the consultation at our earliest availability.Should you not cancel your scheduled consultation within the above 24 hour period, we reserve the right to invoice for the consultation.
TRAVEL TIME AND DISBURSEMENTS
Please note that travel time and travel disbursements will be added to the invoice.RETAINERS
All retainers are required to be paid in advance.Should consultations need to be scheduled, this will be subject to our availability.
TVDM Consultants can provide a monthly account, stating the remainder of the balance of time remaining on the retainer, should this be requested by you.
Should you utilise the full retainer, an invoice will be provided to you for the additional time incurred.Should you wish to cancel your retainer, any time used will be calculated according to our hourly rate, and the remanding amount will be refunded to you.
There is no expiration of on our retainers.
RULES / GOVERNANCE DOCUMENTATION
When amending scheme rules or governance documentation, a complete new document will be provided to you, without track changes and/or comments.
We will hold an initial one hour consultation, held electronically, to discuss your desired amendments and changes to your current set of rules or governance documentation. Following this consultation, we will review your existing rules or governance documentation, or one similar document, and we will provide you with a draft amended set of rules or governance documentation for your consideration and discussion at a thirty minute consultation, held electronically. This is then followed by one round of final amendments to the draft, based on the outcome of the second consultation. Any additional time spent on the instruction will be invoiced at our hourly rate.Our invoice will be sent once the first draft has been sent to you, settlement of same will be required, prior to the second consultation taking place.
Consolidation of sectional title rules does not include review and/or amendments.The instruction for review and/or amendment of your current rules or governance documentation does not include the relevant submission to the Community Schemes Ombud Service.
5 HOUR IN-HOUSE SUPPORT
The in-house support package is required to be paid in advance.The support offered in this package is strictly available to the staff of your Managing Agency only, and cannot be utilised by the trustees or directors of schemes managed by your company.
The services offered in this package include face to face, telephonic and online consultations, as well as brief correspondence via email.
Consultations are subject to our availability.
Should you utilise the full package, an invoice will be provided to you for the additional time incurred.Should you wish to cancel the package, the time used will be calculated according to our hourly rate and the remanding amount will be refunded to you.
There is no expiration of the in-house package.
