The Midstream Homeowners Association (HOA) implemented a new speed enforcement system to improve safety on private estate roads, where a strict 30 km/h speed limit now applies. However, residents have expressed concern over the high value of fines—including penalties of up to R4,000 for a single offence—and the practice of fining homeowners for speeding violations committed by couriers making deliveries to their homes.
Nicole explains that while HOAs are empowered to regulate conduct and enforce safety through estate rules, all penalties must be reasonable, clearly communicated, and in line with Community Schemes Ombud Service principles. She recommends that associations follow fair processes, including warning notices for first offences and a sliding scale for repeat infringements, to ensure compliance without overreach.
